These Terms of Service (the "Terms") are a binding agreement between you and Herrola Team ("Herrola", "we", "us", or "our"). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1) Eligibility (17+)
The Services are intended for users aged 17 and older. By using the Services, you represent that you meet this age requirement and have legal capacity to enter into these Terms.
2) Your account
2.1) Account information
You may need to create an account and provide accurate information such as your name, username, and email address.
2.2) Account security
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us promptly if you suspect unauthorized access.
3) License and acceptable use
3.1) License
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use.
3.2) Acceptable use
You agree not to violate laws, infringe rights, upload content without permission, attempt unauthorized access, disrupt the Services, reverse engineer except where prohibited, or use the Services to create or distribute unlawful or abusive content.
4) Photos, user content, and editing outputs
4.1) Your content
You may provide photos, text, and other materials ("User Content") to use the Services. You retain ownership of your User Content.
4.2) Rights you grant us
You grant Herrola a limited license to host, process, transmit, and display your User Content only as necessary to operate the Services and provide the requested features and outputs.
4.3) No biometric identification
Herrola does not perform face recognition or biometric identification and does not create biometric profiles from your photos.
4.4) One-time processing and deletion (server-side features)
Some features may require or offer optional server-side processing. If you choose to upload photos and/or text prompts, we process them on our own servers and delete them immediately after processing is completed and the result is delivered to you. Your uploaded content is not shared with third parties and is not used for training or marketing.
4.5) Output responsibility
You are responsible for how you use, share, or publish outputs created with the Services, including ensuring you have rights to the underlying content.
5) Privacy
Our collection and use of personal information are described in our Privacy Policy. Please review the Privacy Policy for details.
6) Intellectual property
The Services, including software, design, and all non-user content, are owned by Herrola or its licensors and are protected by intellectual property laws. Except for the license granted above, no rights are granted to you.
7) Feedback
If you provide suggestions or feedback, you grant us the right to use it without restriction or compensation to improve the Services.
8) Termination
You may stop using the Services at any time. We may suspend or terminate your access if we reasonably believe you violated these Terms or if necessary to protect the Services, other users, or our rights.
9) Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." To the maximum extent permitted by law, Herrola disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted, error-free, or secure operation.
10) Limitation of liability
To the maximum extent permitted by law, Herrola will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill arising from your use of the Services. Herrola’s total liability will not exceed the amount you paid (if any) in the 12 months before the event giving rise to the claim.
11) Indemnification
You agree to defend, indemnify, and hold harmless Herrola from and against claims and expenses arising out of your User Content, your use of the Services, or your violation of these Terms or applicable law.
12) Changes to the Services or Terms
We may update the Services and these Terms from time to time. If we make material changes to the Terms, we will provide notice through the Services or other appropriate means. Continued use after the effective date constitutes acceptance.
13) Governing law and dispute resolution (binding arbitration)
These Terms are governed by the laws of Herrola Team’s primary place of business, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Services will be resolved by binding arbitration, except where prohibited by applicable law.
